Boulder Tracker Terms of Use
Last updated: October 4, 2026 Version: 1.0
1. Who we are and what you accept
Boulder Tracker (the "app") is an Android application published by Cristian Felipe Castro Ponce, an individual trading as BClabs ("we"), of Villarrica, Chile, email vulcanoedicionessa@gmail.com.
These terms are the contract between you and us for use of the app. Read them together with the Privacy Policy. By installing or using the app, or by buying Premium, you accept these terms. If you buy Premium, the link to these terms is shown on the purchase screen before you pay. If you do not agree, do not use the app.
2. What the app is
Boulder Tracker is a tool for climbers to log attempts, sends and videos, see statistics and browse a gym catalog. It works mainly on your phone. Some features use third-party services (section 12). We may improve, change or withdraw features, subject to the safeguards in sections 11 and 17.
3. Age and capacity
You must be at least 14 years old to use the app. If you do not meet this requirement, do not use it. The app does not verify age: by using it you state that you meet this requirement. If you are 14-17 (or a minor under your country's law), you use the app at your own responsibility and, where the law requires, with the knowledge and authorization of your parent or legal guardian; you may not buy Premium without that authorization (section 13.11). Nothing in these terms binds you beyond what the law allows to bind a minor, or limits the rights the law gives you as a minor or as a consumer. If you are a parent or guardian and want to exercise rights over a minor's data, see the Privacy Policy (section 11).
4. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app on your Android devices for personal, non-commercial purposes. You may not copy, modify, decompile, reverse engineer, resell, sublicense or circumvent the app's protections, except to the extent mandatory law expressly allows.
5. Your Google account and Google Drive
The app has no accounts of its own. To buy Premium you use your Google Play account, and for cloud backup (Premium) you connect your own Google Drive account. You are responsible for keeping your Google account secure and for Google's terms (including the storage space available in your Drive). The app only accesses the files it creates in your Drive, not your other files. You can disconnect your account at any time. If Google suspends or restricts your account or Drive, backup may stop working and we are not responsible for that.
6. Acceptable use
Do not use the app to: (a) break the law or infringe third-party rights; (b) record other people without their consent, or in changing rooms, restrooms or other private areas; (c) circumvent, manipulate or fake purchases, restores or Premium status; (d) interfere with the app, its services or the third-party services it uses (for example, abusing the Google Drive API); (e) access it by unauthorized automated means; or (f) exploit it commercially or resell it.
7. Your content and third parties in your videos
- It is yours. Your videos, photos, notes, grades and other data are yours. They are stored on your device and, if you turn on backup (Premium), in your own Google Drive account. We do not receive a copy on our servers, we do not see them and we do not use them. We obtain no license over your content, other than the strictly technical one needed for the app to process it on your device and copy it to your Drive at your instruction.
- You are responsible for what you record. Get the consent of the people who appear (and, for minors, of their parents or guardians; bouldering gyms have many children), follow each gym's or venue's rules on photos and video, and respect image-rights and personal-data laws. The app publishes nothing: if you share a video outside it (for example on social media), you do so on your own responsibility and answer to the people who appear.
- Illegal content. Do not store or share with the app content that is illegal or infringes third-party rights.
- Backups. Back up your content. If you uninstall the app, reset your phone or lose it without a backup, your data may be lost.
- When you stop. If you cancel Premium or stop using the app, you keep your local videos and data and everything already backed up in your Drive; we do not delete or lock them.
8. Climbing safety (important)
Climbing, bouldering and physical training are risky activities that can cause serious injury or death. The app is only a logging tool: it does not teach technique and provides no instruction, supervision, assessment of your ability or safety advice, and what you record or see in it (grades, notes, streaks, statistics, gym information) is no substitute for your own judgment, a qualified instructor, or the rules of the venue. You decide for yourself whether and how to climb, and you accept the risks inherent in the activity. Do not use your phone or record in a way that distracts you or others while climbing, belaying or standing beneath a wall. This section is subject to section 16.
9. Gym catalog, third-party data and OpenStreetMap
- For reference only. Gym data in the app (addresses, contacts, hours, social links) is for reference only, comes from public sources and may be incomplete, outdated or inaccurate. Check with each gym before visiting.
- Source. Outside Chile, the catalog contains information from OpenStreetMap (© OpenStreetMap contributors, openstreetmap.org/copyright), available under the Open Database License (ODbL) 1.0. The derived catalog included in the app is a derivative database of OpenStreetMap and is offered under the ODbL 1.0 at https://vulcanoedicionessa.github.io/boulder-tracker-legal/datos/. Anyone can correct the source data at openstreetmap.org. This license applies to the catalog data, not to the app's code or design. For Chile, the catalog is our own preliminary one, built from public information.
- Trademarks. Gym names and other third-party trademarks belong to their owners; mentioning them does not imply affiliation, sponsorship or endorsement.
- Correction or removal. If you own or represent a gym, or are the person a data item refers to, and want it corrected or removed, write to vulcanoedicionessa@gmail.com stating the gym and your request; we will respond within a reasonable time.
10. AI-generated example images
The images and photos shown in the app's store-listing screenshots were generated with artificial intelligence, and the people and gyms shown as examples are fictional. The interface shown is the app's. The app does not itself generate content with artificial intelligence.
11. Free version and ads
The free version shows third-party ads (Google AdMob), labeled as ads. We do not control their content and are not responsible for advertised products or services. Ads are always non-personalized. You can manage your ad consent in Settings → Privacy and ads, and remove ads with Premium. The data processing associated with ads is explained in the Privacy Policy.
12. Third-party services
The app works with third-party services (Google Drive, Google AdMob, Google Play, RevenueCat). Their use is also governed by their own terms and policies, and we do not control their availability. If they become unavailable we will make reasonable efforts to keep the app's core functions working.
13. Premium (paid subscription)
13.1 What it includes. Premium removes ads and enables cloud backup to your own Google Drive, including the ability to free up phone space while keeping videos in that backup, plus whatever the Premium screen lists from time to time. Backup depends on your connection, your Google account and your Drive space. 13.2 Who sells and charges. You buy and pay through Google Play with your Google account. Depending on your country, the seller is Google (for example Google Commerce Limited in the European Economic Area and the UK) or us; in both cases Google Play's terms also apply. The purchase is validated through RevenueCat, which receives an anonymous purchase identifier. 13.3 Price. The price, currency and period (monthly or yearly) are shown on the purchase screen before you pay, with taxes included or added depending on your country. Google Play sets the currency and exchange rate; your bank may charge its own fees. 13.4 Automatic renewal. The subscription is charged when you confirm it and renews automatically for equal periods (each month or year) at the same price until you cancel. 13.5 Cancellation. You can cancel at any time, without giving a reason, in Google Play → Payments & subscriptions → Subscriptions → Boulder Tracker, or from the "Manage subscription" button on the Premium screen. You keep Premium until the end of the period already paid and you will not be charged again. Cancelling does not by itself refund the current period, without prejudice to section 13.7. 13.6 Restore purchases. From the Premium screen, using the same Google account you bought with. 13.7 Withdrawal, right of regret and refunds. - European Union and United Kingdom. If you buy as a consumer, you have the right to withdraw from the subscription contract within 14 days of purchase, without giving a reason. If you expressly ask for Premium to start during that period and then withdraw, you must pay a proportionate amount for what has been provided up to the time you tell us of your withdrawal. Where digital content is supplied with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal, that right may be lost once supply begins, as far as the law allows. To exercise it, use Google Play's refund request (https://support.google.com/googleplay/answer/2479637) or email vulcanoedicionessa@gmail.com with your order number; an unequivocal statement is enough. We will acknowledge receipt and, where applicable, refund through the same payment method without undue delay and within 14 days of being told of the withdrawal (Google Play refunds are also subject to Google's timelines). - Brazil. You have a 7-day right of regret from purchase (art. 49 of the Consumer Defense Code), with a refund of what you paid, through Google Play or us. - Chile. The rights of Law 19,496 protect you, including the right of withdrawal in the cases and periods in which that law recognizes it for distance contracts. You can exercise it through Google Play or by writing to us. - Other countries and refunds outside those periods. Governed by Google Play's refund policy and the mandatory law of your country. If Premium does not work or is not as described, you also have the remedies in section 17. 13.8 Price changes. If we change the price we will notify you at least 30 days in advance and, where Google Play requires, ask you to accept it. If you do not accept, you can cancel before it applies; the new price does not affect the period already paid. 13.9 When Premium ends. You keep your local videos and data and everything already backed up in your Drive; only Premium features turn off (for example, uploading new videos to backup, and ads return). You will still be able to restore what was already backed up 13.10 Free trials and offers. We do not currently offer a free trial. If we do in the future, the terms (length, price afterwards, date of first charge and how to cancel) will be shown before you accept. 13.11 Under 18s. If you are under 18, you may buy Premium only with the authorization of your parent or legal guardian or if an adult buys it with their own Google Play account, under Google Play's terms and your country's consumer law. We will show a notice on the purchase screen. If it is bought without valid authorization, you or your representative may ask us (or Google Play) for cancellation and a refund to the extent the law allows, by writing to vulcanoedicionessa@gmail.com.
14. Intellectual property
The app, its design, its "Boulder Tracker" name, the BClabs mark and its code belong to Cristian Felipe Castro Ponce or its licensors and are protected by law. Third-party trademarks (including Google, AdMob, Google Drive, Google Play, Android, OpenStreetMap, Instagram and Facebook) belong to their owners; Boulder Tracker is not affiliated with or endorsed by them or by any gym in the catalog. The app includes open-source components under their own licenses, whose notices are shown in the app.
15. App quality and legal guarantee
We make reasonable efforts for the app to work as described, but cannot guarantee uninterrupted or error-free operation. If you are a consumer you keep the statutory guarantees of your country (for example conformity of digital content and services in the European Union and the United Kingdom, Law 19,496 in Chile or the Consumer Defense Code in Brazil): if the app or Premium does not conform to what was offered, you may require us to bring it into conformity, a price reduction, or termination of the contract with a refund, as that law provides. These terms do not limit those rights. In other cases the app is provided "as is" and "as available" to the extent the law allows.
16. Liability
16.1 What is never limited. Nothing in these terms excludes or limits our liability for willful misconduct or gross negligence, for fraud, for death or personal injury caused by our negligence, or any other liability that the law does not allow to be excluded or limited, nor your mandatory consumer rights. 16.2 Physical activity. Because the app does not teach or supervise climbing, we are not liable for injuries, accidents or damage you suffer or cause while climbing, training or recording, except in the cases in section 16.1. 16.3 Data and indirect loss. To the extent the law allows, we are not liable for data loss that depends on you (for example not making a backup) or for indirect loss or lost profits. 16.4 Cap. To the extent applicable law allows (and, for consumers, only where their country's law permits), our total liability for claims relating to the app will not exceed what you paid for Premium in the 12 months before the event.
17. Suspension and termination
By you: you can stop using the app at any time by uninstalling it, and cancel Premium under section 13.5. By us: we may suspend or end access to Premium or the app if you seriously breach these terms or the law, or if a law requires us to; we will tell you in the app or by email if we have it, unless that is not possible or the law forbids it, and give you a reasonable chance to fix a breach that can be fixed. If we stop offering Premium or the app for reasons not attributable to you, we will refund the proportionate part of the period paid and unused. Effects: on termination, accrued rights and obligations and clauses that by nature should survive (for example sections 14, 16 and 19) remain.
18. Changes to the terms or to Premium
We may update these terms or Premium features for legal, technical, security or service-improvement reasons. We will publish the new version with its date and, if the change is important or unfavorable to you, notify you in the app at least 30 days before it applies. We will not change what you have already contracted and paid for the current period. If you disagree with a change that disadvantages you more than minimally, you may reject it, stop using the app and cancel Premium before it takes effect, with a proportionate refund of the period already paid and not enjoyed. If, having been so informed, you keep using the app after the effective date, you are taken to accept the new version, unless your country's mandatory law requires otherwise. Changes required by law may apply within the period the law sets.
19. Complaints, governing law and courts
Complaints. Write to us first at vulcanoedicionessa@gmail.com with the subject "Complaint"; we will reply within 10 business days. If you are not satisfied you may go to your country's consumer authority (for example SERNAC in Chile, Procon or consumidor.gov.br in Brazil) or to any alternative dispute resolution body that applies. We do not take part in proceedings before consumer alternative-dispute-resolution bodies unless the law requires us to. Governing law. These terms are governed by the laws of Chile. If you are a consumer, you are also protected, and no clause can exclude it, by the mandatory consumer-protection rules of your country of habitual residence. Courts. If you are a consumer, you may bring claims before the competent courts or authorities of your country of residence or, in Chile, the competent Local Police Court (Juzgado de Policía Local) under Law 19,496; and you may be sued only in the courts of your country of residence where the law so provides. For anyone else, disputes go to the ordinary courts of Villarrica, Chile.
20. Languages
These terms are published in Spanish, English, French, Italian, Portuguese (Brazil) and German. If you are a consumer and the law of your country requires the terms to be available in your language, we will provide them in that language before you contract. Where several versions exist, all have the same value for you in the language in which you use the app, and in case of doubt the interpretation most favorable to the consumer applies. Between all other parties, the Spanish version prevails.
21. General
If any clause is found invalid or unenforceable, the rest remains in force and the clause will be replaced by a valid one as close as possible to its purpose. These terms and the Privacy Policy are the entire agreement between you and us about the app. Not exercising a right is not a waiver of it. You may not assign these terms without our consent; we may assign them to whoever acquires the app, notifying you, if this does not prejudice you. We are not liable for failures caused by events beyond our reasonable control. Do not use the app where sanctions or export law forbids it.
